CCI will investigate Odisha State Civil Supplies Corp for anti-competitive practices

New Delhi, November 1 () The Indian Competition Commission on Friday ordered a detailed investigation against Odisha State Civil Supplies Corporation Ltd for alleged unfair commercial forms regarding the contracting of custom milling services for rice.

In this case, the regulator considered the market for acquiring personalized rice milling services in the state of Odisha as the relevant one. He also found that the entity is prima-facie dominant in the relevant market.

The investigation has been ordered by a complaint filed by Maa Metakani Rice Industries, based in Odisha, which refers to the milling and production of rice, among others. It acts as a custom milling agent for Odisha State Civil Supplies Corporation.

According to the control agency, the main complaints of market abuse are related to the entity's conduct in the non-liquidation of the CMR quotas of the Maa Metakani Rice Industries and the imposition of unfair conditions by the millers to reach an agreement for custom grinding for the marketing season of Kharif (KMS) 2018-19.

CMR refers to custom ground rice.

In its 14-page order, the ICC said that, according to the documents that are registered, it seems that Odisha State Civil Supplies Corp.

The Commission, at this stage, without delving into the details of the abuse, as alleged, is of the prima facie opinion that the issue requires investigation, he said.

In addition, the control body said that the allegation of arbitrary disclosure of criteria for the selection of custom millers to participate in the 2017-18 KMS rabbi season should also be investigated by the CEO (DG).

The DG is the research arm of the ICC. The regulator also made it clear that nothing in the order would amount to a final expression of opinion on the merits of the case. RAM HRS
