SC remains well imposed on Vishal Dadlani and Tehseen Poonawalla

The Supreme Court on Monday suspended the order of the High Court of Punjab and Haryana imposing a fine of Rs 10 lakh on the activists. Tehseen Poonawalla and composer and music singer Vishal Dadlani for mocking the monk Jain Tarun Sagar .

A bank of judges Rohinton Nariman & Surya Kant also issued notice to the Haryana Government on the plea filed by Tehseen Poonawalla against the judgment of the Punjab & Haryana High Court.

The Punjab & Haryana High Court had asked Vishal Dadlani & Tehseen Poonawalla to pay Rs 10 lakh each to get the FIR against them quashed. The high court has also quashed the FIR & said that the fine was imposed to give a message so that no one mocked the heads of religious sects.

Dadlani & Poonawalla were booked by the Haryana Police in August 2016 in Ambala Cantonment for hurting the religious sentiments of the Jain community.

They had made comments on social media in August 2016 after the Haryana government had invited revered Jain monk, Muni Tarun Sagar, to address the Haryana Assembly on August 25, 2016.

Both had moved to the Superior Court for annulling the FIR after the Supreme Court, in September 2016, ordered them to approach the Superior Court.

The case against both was registered for deliberate & malicious acts intended to outrage the religious feelings & other offences under Sections 295-A, 153-A & 509 of the IPC (Indian Penal Code) at Ambala Cantonment police station.
