Bombay HC asks for investigation report in Palghar mafia lynching case
MUMBAI: On Thursday it issued a notice to the state and requested its response with an update on the status of the investigation into it. The HC also sought a report on the internal investigation by additional police superintendent Raigad against the police officers, who were transferred.
A Delhi lawyer had filed public interest litigation with the Bombay High Court demanding an investigation by the Central Bureau of Investigation (CBI) or the Special Investigation Team (SIT) under judicial supervision in the recent Palghar lynching case.
The state has already ordered an investigation through the state's Crime Investigation Department (CID). The HC requested a response before May 20, when the matter will be heard again.
On the night of April 16, a mob had lynched three men, including two seers and a driver on their way to a funeral in Surat. The mob allegedly suspected that they were child abductors and organ harvesters.
Government defender PP Kakade said more than 30 police officers were transferred and that an internal investigation was underway.
It is in the interest of justice that a free and fair investigation be conducted in the present case under the supervision of the superior court. There are serious allegations of commission and omission by local police personnel in the brutal crime mentioned above. and therefore, it is in the interests of justice that the investigation of the instant case be carried out by any independent agency, other than an agency subordinate to the State of Maharashtra, '' PIL said.
