Each used the other: Allahabad HC observes while granting bail to the accused rape of Chinmayanand
ALLAHABAD: The Allahabad High Court on Monday granted bail to the former Union Minister and high-ranking official of BJP, who was arrested in a case of sexual exploitation of a woman studying law at a university run by her trust in Shahjahanpur , while observing that both used each other. Judge Rahul Chaturvedi said: “Both parties crossed their boundaries and at this stage, it is very difficult to judge who exploited whom. In fact, they both used each other.
Taking note of the woman's claim, the court had the trial transferred to Lucknow
The court imposed a series of conditions when granting bail to Chinmayanand. Given the woman's claim that Chinmayanand may alter the evidence, the court ordered the transfer of the trial to the Lucknow district court, which will consider it a priority and try to conclude the trial within a year.
The court also ordered the Lucknow police superintendent to guarantee the safety of the woman, her family and witnesses during the trial.
The court ordered Chinmayanand to remain personally present on important dates. In case of being absent without giving an adequate reason, it would be considered abuse of bail. On September 2, the Supreme Court had ordered the UP government to set up a special investigation team to investigate the charge of sexual harassment against Chinmayanand. Chinmanayand was arrested on September 20 by the SIT in Shahajahanpur. Later, the SIT also registered a case against the woman, her three friends and an unnamed person, claiming they tried to extort Chinmayanand. The woman and her three friends were arrested accordingly. The superior court granted bail on December 4, 2019.
